Terms of Service

1. Introduction
These Terms of Service (“Terms”) govern your use of the website located at houstonsewingrepair.com (the “Website”) and the sewing machine and serger repair, maintenance, and diagnostic services (the “Services”) offered by FlameGrower LLC, a Texas limited liability company doing business as Houston Sewing Repair (“Houston Sewing Repair,” “Company,” “we,” “us,” or “our”).
By accessing the Website, submitting a service request or photo, scheduling an appointment, or dropping off equipment, you (“Customer,” “you,” or “your”) agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Website or Services.
2. Definitions
For purposes of these Terms, the following definitions apply:
- “Equipment” means any sewing machine, serger, overlock machine, coverstitch machine, embroidery machine, or related device dropped off or submitted for Service.
- “Diagnostic Fee” means the non-refundable $50.00 fee charged to inspect and evaluate Equipment and provide a repair estimate.
- “Repair Services” means the labor and parts, if any, performed or provided to diagnose, clean, adjust, repair, or maintain Equipment.
- “Service Ticket” means the written or electronic record documenting the Equipment received, the Diagnostic Fee, and any authorized Repair Services and associated charges.
3. Services
Houston Sewing Repair provides the following Services on a best-effort basis:
- Diagnostic Evaluation — $50.00 (applied toward repair if Customer proceeds)
- Cleaning & Maintenance — $99.00
- Timing Adjustment — $119.00
- Tension & Mechanical Repair — $139.00
- Full Service — $199.00
All pricing is subject to change without notice. Prices quoted at the time of your Service Ticket will control. The Company reserves the right to decline service to any person or for any Equipment at its sole discretion.
Appointment Required. All Services are provided by appointment only. We do not accept walk-ins. Our hours of operation are Wednesday through Sunday, 10:00 AM to 5:00 PM. We are closed Monday and Tuesday. Appointments may be scheduled by calling (888) 874-4988 or through our Website.
4. Diagnostic Fee and Estimates
A $50.00 Diagnostic Fee is charged to inspect and evaluate your Equipment. This fee is non-refundable if you decline to proceed with recommended Repair Services. If you authorize Repair Services, the Diagnostic Fee is credited toward the total cost of the repair.
Any estimates or quotes provided — whether via our Website photo upload form, by phone, or in person — are preliminary and based on the information available at the time. Final pricing may differ after physical inspection. We will obtain your approval before performing any Repair Services that exceed the original estimate by more than $25.00.
5. Customer Responsibilities
By dropping off Equipment, you represent and warrant that:
- You are the legal owner of the Equipment or are authorized by the owner to commission repairs.
- You have backed up all digital settings, stitch patterns, embroidery designs, and custom programming stored on the Equipment before drop-off. Houston Sewing Repair is not responsible for loss of digital data, settings, or programmed content on any Equipment.
- You have disclosed any known issues, prior repair attempts, or modifications made to the Equipment.
6. Photo Submissions
Photos submitted through our Website become the property of Houston Sewing Repair and may be used for diagnostic evaluation, internal training, quality assurance, and marketing purposes. By submitting photos, you grant the Company a perpetual, royalty-free, worldwide license to use, reproduce, and display those images. We do not publicly display identifying information alongside submitted photos without your consent.
7. Payment Terms
Payment is due at pickup unless other arrangements have been agreed to in writing. We accept cash, major credit cards, and debit cards.
Lien on Equipment. Houston Sewing Repair retains a possessory lien on all Equipment left for service until all outstanding charges for Repair Services, parts, and the Diagnostic Fee are paid in full. If payment is not made within the timeframes set forth in Section 10 (Abandoned Equipment), Houston Sewing Repair may exercise all rights available under Texas law, including the right to sell the Equipment to satisfy unpaid charges.
8. No Warranty; As-Is Service
ALL REPAIR SERVICES ARE PERFORMED ON A BEST-EFFORT BASIS AND PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. Houston Sewing Repair makes no guarantee, representation, or warranty that any particular issue will be resolved, that Equipment will be restored to original factory condition, or that repaired Equipment will function free of any further issues.
Much of the Equipment we service is older, previously used, or may have pre-existing conditions that affect repairability. Houston Sewing Repair expressly disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. No employee, contractor, or agent of Houston Sewing Repair is authorized to make any warranty or representation that contradicts this Section.
9. Limitation of Liability
To the fullest extent permitted by law, Houston Sewing Repair, FlameGrower LLC, and their members, managers, employees, contractors, and agents shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost business opportunity, or business interruption;
- Damage to the Equipment beyond the value of the Repair Services performed, with total liability capped at the amount actually paid by Customer for the specific Service Ticket at issue;
- Loss of digital data, settings, stitch patterns, embroidery designs, or custom programming stored on Equipment;
- Damage or loss resulting from pre-existing conditions, normal wear and tear, or manufacturing defects in the Equipment.
This limitation applies regardless of the legal theory on which a claim is based, including negligence, breach of contract, strict liability, or otherwise, even if Houston Sewing Repair has been advised of the possibility of such damages.
10. Abandoned Equipment
If Equipment is not picked up and all charges are not paid in full within sixty (60) calendar days after Houston Sewing Repair provides notice (by phone, email, or text message) that the Repair Services are complete and the Equipment is ready for pickup, the Equipment shall be deemed abandoned.
Upon abandonment, title to the Equipment shall transfer to FlameGrower LLC, free and clear of any claims by Customer. Houston Sewing Repair may, in its sole discretion, dispose of, sell, donate, or retain the abandoned Equipment. Any proceeds from the sale of abandoned Equipment shall first be applied to outstanding Service charges and storage costs; any remaining balance shall be retained by the Company. Customer remains liable for any deficiency if sale proceeds do not cover all outstanding charges.
Storage Fees. Houston Sewing Repair reserves the right to charge reasonable storage fees for Equipment not picked up within fourteen (14) calendar days of completion notice. Any storage fees will be communicated to Customer in advance and added to the total due before release of the Equipment.
11. Trademark Disclaimer
Houston Sewing Repair is not an authorized representative, dealer, distributor, or service center of any sewing machine, serger, or equipment manufacturer. All trademarks, brand names, logos, and product names referenced on our Website or in our materials — including but not limited to Singer, Brother, Janome, Juki, Babylock, Bernina, Pfaff, and Husqvarna Viking — are the property of their respective owners. Use of these names does not imply endorsement, sponsorship, or affiliation with Houston Sewing Repair. We service Equipment from all major brands on an independent basis.
12. Indemnification
You agree to indemnify, defend, and hold harmless Houston Sewing Repair, FlameGrower LLC, and their members, managers, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your misrepresentation regarding ownership of Equipment; (c) your failure to back up digital data; or (d) any claim by a third party that Equipment you submitted for service infringes upon that party’s intellectual property rights.
13. Dispute Resolution; Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Website, the Services, or the Equipment — including disputes about the scope, validity, or enforceability of this arbitration provision — shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules in effect at the time the arbitration is commenced.
The arbitration shall take place in Harris County, Texas. The arbitrator shall apply Texas law consistent with the Federal Arbitration Act. Judgment on the arbitrator’s award may be entered in any court of competent jurisdiction. Each party shall bear its own attorneys’ fees, costs, and expenses, unless the arbitrator awards fees to the prevailing party as permitted by law.
Waiver of Class Action and Jury Trial. All disputes shall be resolved on an individual basis. You waive any right to bring or participate in a class action, class arbitration, representative action, or consolidated proceeding against Houston Sewing Repair. You also waive your right to a jury trial.
If this arbitration provision is found to be unenforceable, any litigation shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.
14. Governing Law
These Terms and any dispute arising out of or related to them shall be governed exclusively by the laws of the State of Texas, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
15. Privacy
Your use of the Website and Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our Website or Services, you consent to the practices described in the Privacy Policy.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Website or Services after the effective date constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
17. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it enforceable, consistent with the original intent of these Terms.
18. Entire Agreement
These Terms, together with any Service Ticket and the Privacy Policy, constitute the entire agreement between you and Houston Sewing Repair regarding the subject matter hereof and supersede all prior or contemporaneous oral or written communications, understandings, or agreements.
